Terms of Service

Please read these terms carefully. By using Check-Up, you agree to them.

These Terms of Service ("Terms") are a binding agreement between you and Check-Up Basketball ("Check-Up," "we," "us," or "our") and govern your access to and use of the Check-Up mobile application, the checkupbasketball.com website, and all related features and services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Who Can Use Check-Up

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction (typically 18), you may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms. Certain features — including selling tickets, receiving payouts, hosting paid events, and purchasing subscriptions — require you to be at least 18. You are responsible for ensuring your use of the Service is legal where you live.

2. Your Account

You agree to provide accurate information, keep it up to date, and keep your login credentials secure. You are responsible for all activity that happens under your account. Notify us promptly at checkupbasketball@gmail.com if you suspect unauthorized use. You can delete your account at any time from within the app under Settings, or via our account deletion page.

3. The Platform — and What We Are Not

Check-Up is a technology platform that connects players, hosts, coaches, court owners, and organizers. We are not the organizer, operator, promoter, sponsor, or insurer of any event, game, run, tournament, training session, camp, league, or court booking listed on the Service. Events and listings are created and controlled entirely by the users who post them ("Hosts"). Check-Up does not verify, endorse, or guarantee any event, Host, venue, court, coach, participant, or the accuracy of any listing.

Any agreement to attend, host, pay for, or participate in an event or booking is solely between the participants and the Host. We are not a party to those interactions and are not responsible for the conduct, safety, qualifications, or actions (online or offline) of any user, Host, or third party.

4. Assumption of Risk & Release of Liability

Basketball and related physical activities are inherently dangerous and carry the risk of serious injury, permanent disability, or death. By using the Service to discover, organize, or join any event, game, run, tournament, training, or court booking, you knowingly and voluntarily acknowledge and accept all risks of participation, including but not limited to physical injury, contact with other participants, equipment or facility hazards, weather and travel risks, theft or loss of property, and the conduct of other participants.

To the fullest extent permitted by law, you release, waive, and discharge Check-Up, its founders, officers, employees, and agents from any and all claims, demands, liabilities, damages, or expenses of any kind arising out of or relating to your participation in, or attendance at, any event, game, booking, or activity discovered or arranged through the Service — whether caused by negligence or otherwise. You are solely responsible for determining whether you are physically fit to participate and for arranging your own health, accident, and liability insurance.

If you host an event, you are solely responsible for its safety, legal compliance, permits, supervision, venue suitability, and for any harm arising from it, and you agree to indemnify Check-Up as described in Section 11.

5. Payments, Tickets & Bookings

Some features let you buy event tickets, pay for court bookings, make donations, or subscribe to premium features. Card payments are processed by our third-party payment processor, Stripe. In-app subscriptions purchased on iOS are processed by Apple through the App Store, and on Android by Google Play, under their respective terms. We do not collect or store your full payment card numbers; that information is handled directly by these processors.

  • Event tickets & bookings: Prices, availability, entry requirements, cancellations, and refunds are set and controlled by the Host. Check-Up is not responsible for a Host's failure to hold an event, honor a booking, or issue a refund. Refund requests for Host-run events should be directed to the Host.
  • Platform fees: Check-Up and its payment processors may charge service, processing, or platform fees, which will be disclosed before you complete a purchase. Fees are generally non-refundable except where required by law.
  • Subscriptions: Subscriptions renew automatically until cancelled. You can manage or cancel a subscription through your App Store or Google Play account settings. App-store purchases are subject to the store's refund policies.
  • Payouts to Hosts: Hosts who receive payments are responsible for delivering what they sell and for their own taxes. You authorize us and Stripe to facilitate the collection and remittance of funds on your behalf.

6. User Content

The Service lets you post content — including profiles, photos, videos, Score Cam clips, highlights, game scores, brackets, event listings, comments, and messages ("User Content"). You retain ownership of your User Content. By posting it, you grant Check-Up a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (e.g., for formatting or thumbnails), display, and distribute that content for the purpose of operating, promoting, and improving the Service.

You represent that you own or have the rights to the content you post, that it does not violate any law or third-party right, and that any person recognizable in your photos or videos has consented to your posting it. You are solely responsible for your User Content.

7. Acceptable Use

You agree not to:

  • Break the law, infringe others' rights, or post content that is harassing, hateful, threatening, defamatory, obscene, or violent;
  • Impersonate others, create fake events, scam users, or misrepresent your affiliation;
  • Record, photograph, or stream people without the consent required in their location;
  • Upload malware, scrape or reverse-engineer the Service, or interfere with its security or operation;
  • Use the Service for any unauthorized commercial purpose or to collect others' personal information.

We may remove content, suspend, or terminate accounts that violate these Terms, at our discretion.

8. Content Moderation & Copyright

We are not obligated to monitor User Content but may review, remove, or restrict any content for any reason. If you believe content on the Service infringes your copyright, email checkupbasketball@gmail.com with a description of the work, the location of the infringing material, your contact information, and a good-faith statement of infringement. We respond to valid notices and may remove infringing content and terminate repeat infringers.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the conduct of users or Hosts, the safety or accuracy of events, or that the Service will be uninterrupted, secure, or error-free. Any information provided through the Service (including locations, times, scores, and statistics) may contain errors and is not guaranteed.

10. Limitation of Liability

To the fullest extent permitted by law, Check-Up and its founders, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or property damage, arising from or related to your use of (or inability to use) the Service, any event or booking, or the conduct of any user or third party. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid to Check-Up in the three (3) months before the claim or USD $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless Check-Up and its founders, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, any event or booking you host or attend, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including Sections 4, 9, 10, 11, and 13) will survive.

13. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which Check-Up Basketball is established, without regard to conflict of law rules. To the extent permitted by law, you and Check-Up agree to resolve disputes individually (not as a class action) through binding arbitration or in the courts located in that jurisdiction, and you waive any objection to venue there. Nothing in this section prevents either party from seeking injunctive relief for intellectual property or misuse claims.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect means you accept the updated Terms.
